So given that the defense for being over the limit is that they have to prove that you’re impaired, how would they go about that? If it’s by administering a roadside test, walk along the line, touch your nose, recite the alphabet etc, that’s a bit concerning. I’ve seen multiple accounts from police saying that the tests are entirely subjective and that they can easily influence the test in order to practically guarantee a fail.
