Appears Chevron overturned.
Well boys and girls, it looks like the Supreme Court overthrew Chevron in the NOAA Fisheries case.
My understanding is that this no longer allows government agencies have the leeway and excuse of their "best interpretation" of written law in court cases and should make it harder for those agencies to get away with abusing power.
This decision doesn't roll back any previous rulings, it removes the precedent that allowed those agencies to use it as a loophole around congress and tricky subjects. This should make it so cases moving forward are more fair. I'm hoping this puts an end to the "rule" changing game the ATF has been fond of in recent years.
Here's to hoping the boys in the GOA, FPC, and other groups are able to use this as an advantage to win back some ground in future cases and that it forces the ATF the behave making the NFA process better and easier as we work towards a better tomorrow.
